In a written statement made by the ICJ, it was announced that Nicaragua filed a lawsuit against Germany.

According to the statement, Nicaragua accused Germany of failing to fulfill its international obligations in the occupied Palestinian territories, particularly in the Gaza Strip.

In its application to the Court, Nicaragua charged that Germany, by providing political, financial and military support to Israel, and by cutting funding to the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), “facilitated the commission of genocide by Israel and in any event failed to fulfill its obligation to do everything possible to prevent genocide.”

Nicaragua argued that Germany’s support for Israel violated the 1948 Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention), the 1949 Geneva Conventions and Additional Protocols, the inviolable principles of international humanitarian law, and other general norms of international law.

Pointing to the “confirmed risk of genocide against the Palestinian people in the Gaza Strip” since October 2023, Nicaragua recalled that “every State Party to the Genocide Convention is obliged under the Convention to do everything possible to prevent the commission of this crime.”

Nicaragua requested the Court to grant injunctive relief pursuant to Article 41 of the ICJ Statute and Articles 73, 74 and 75 of its Rules of Procedure on the grounds that “Germany is participating in the possible genocide in the Gaza Strip and in serious violations of international humanitarian law and other mandatory norms of general international law”.
